My mug shot is all over the internet. Here is the partial story of how i came to be arrested.
District Family court judge gerard lavelle ordered a mother (me) to be detained (arrested) during a hearing. I was asking to see my child after he was illegally removed from my custody on Jan 9, 2015.
The judgement included jailing me at the MDC city jail for an undisclosed amount of time with a no bond hold.
Because i had no prior criminal record, no pending charges, i had never been charged with a crime before, the criminal arm of the State of NM looked into my case.
Civil/family court and criminal court have two different laws governing the hearings. Because a person can loose their freedom (be incarcerated) when criminal charges are filed, the individual is legally provided with a state lawyer, if they cannot afford a private attorney. Everyone has seen enough TV to know this.
I was in family court requesting to see my child (again) when i was arrested with a maximum of 364 days to be served in city jail with no bond. Due to the almost $100,000 dollars this family court has court ordered me to pay, i am bankrupt and cannot afford a private family lawyer. I was pro se (without legal representation) at the hearing.
Same as every hearing, the father of my child and his crooked attorney made up lies about me at court. When i requested a continuance to bring to court a retired APD officer who is now a licensed PI in the states of TX and NM to tell the court that they were lying, i was denied a continuance for my expert witness.
When i requested a continuance to obtain legal counsel, because the judge threatened me with jail, i was denied the right to legal counsel too.
I was then arrested, with the father of my child and his lawyer laughing at me as i cried while being handcuffed. As i was escorted out of the courtroom, the officers high-fived him.
Family court had just arrested me for 364 days without legal representation and refusing me a continuance for an expert witness to clarify the perjury committed by both the lawyer and her client. The law offices of the public defender found out about my case. The State of NM filed two grievances against this judge for: 1. abuse of power and 2. excessive punishment.
The judge would not budge and would not release me from state custody. Nina Seifer, a criminal attorney from the LOPD, the criminal arm of the State of NM, entered an appearance in my domestic matters, civil case as my lawyer, on my behalf in family court to plead with the judge to release me from state custody.
(After the law offices of the public defender had been able to have me released from jail, the judge then court ordered me to go into the CCP program, again for another 364 days with no possibility of being released. I was on home arrest with an ankle bracelet thru Christmas)
I spent about 3 months in the CCP program, being the only individual in the history of the program to have ever have been sentenced to serve time on house arrest with an ankle bracelet from a civil hearing.
Even after the complaints against this abusive judge were made by the STATE of NM, his political contacts just swept his continued abuse of me and continued violation of my civil rights under the rug, and he continues to preside over my case. YUP. He's still the judge on my case and he was never punished or disciplined for breaking the law.
The level of corruption at the Bernalillo Family Courts is out of control. I pray that someone in the news will someday pick up my story and bring justice to my case, not for my sake, but for the sake of my child and all of the other children being abused by the current broken family court system.
